This webinar will discuss the legitimacy of the Guantánamo Bay war crimes tribunals from an IHL and ICL perspective. It brings together the world’s leading IHL and ICL authorities to discuss the rights granted to detainees captured in armed conflict and whether the trial of ‘unprivileged enemy belligerents’ at Guantánamo Bay complies with the Geneva Conventions and customary international humanitarian law.

The trial of so-called ‘unprivileged enemy belligerents’ by war crimes tribunals at Guantánamo Bay is one of the most important IHL and ICL questions of the century. The question is particularly timely, given the fact that the 9/11 case (US v Khalid Sheikh Mohammed et al), one of the most complex ICL cases in US history at the first American war crimes tribunal since the Second World War, is moving towards trial at Guantánamo Bay after nearly two decades of delay.
